Stay Access is a short-stay booking platform designed for modern travel. We connect users with flexible accommodation options that allow bookings for a few hours, overnight stays, or between journeys.

Stay Access acts as an intermediary between users and accommodation providers and does not own, operate, or manage the listed properties.

2. Eligibility

To use Stay Access, you must:

  • Be at least 18 years old

  • Have the legal capacity to enter into binding agreements

  • Provide accurate, current, and complete registration information

You are responsible for maintaining the confidentiality of your account credentials.

3. Account Registration and Use

  • Users must create an account to make bookings

  • You agree to provide truthful and accurate information

  • You are responsible for all activities conducted through your account

  • Stay Access reserves the right to suspend or terminate accounts that violate these Terms

4. Bookings and Payments

  • All bookings are subject to availability and acceptance by the accommodation provider

  • Prices, stay durations, and policies are set by the accommodation providers

  • Payments are processed securely through third-party payment providers

  • Stay Access is not responsible for payment processing errors caused by third parties

5. Cancellations, Changes, and Refunds

  • Cancellation and refund policies vary by accommodation provider

  • Users are responsible for reviewing the specific cancellation terms before confirming a booking

  • Stay Access does not guarantee refunds unless explicitly stated in the booking terms

6. Check-In, Stay Rules, and Conduct

  • Check-in and check-out times are determined by the accommodation provider

  • Users must comply with property rules, local laws, and regulations

  • Any damage, loss, or misconduct during a stay is the responsibility of the user

7. User Responsibilities

You agree not to:

  • Use the Platform for unlawful or fraudulent purposes

  • Provide false information or impersonate others

  • Interfere with the security or functionality of the Platform

  • Circumvent fees, policies, or booking procedures

8. Host and Third-Party Responsibilities

Accommodation providers are solely responsible for:

  • The accuracy of listing information

  • The quality, safety, and legality of their accommodations

  • Compliance with local laws and licensing requirements

Stay Access does not guarantee the condition, suitability, or availability of any listed accommodation.

9. Intellectual Property

All content on the Platform, including logos, text, graphics, and software, is the property of Stay Access or its licensors and is protected by applicable intellectual property laws.

You may not copy, modify, distribute, or exploit any content without prior written consent.

10. Limitation of Liability

To the maximum extent permitted by law, Stay Access shall not be liable for:

  • Any indirect, incidental, or consequential damages

  • Losses arising from accommodation quality, cancellations, or user conduct

  • Acts, omissions, or disputes involving accommodation providers

Use of the Platform is at your own risk.

11. Indemnification

You agree to indemnify and hold harmless Stay Access, its directors, employees, and partners from any claims, damages, or expenses arising out of your use of the Platform or violation of these Terms.

12. Suspension and Termination

Stay Access reserves the right to suspend or terminate your access to the Platform at any time if you:

  • Breach these Terms

  • Engage in fraudulent or harmful activities

  • Misuse the Platform or services

13. Privacy

Your use of the Platform is also governed by our Privacy Policy, which explains how we collect and process personal data.

14. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of Kenya.
